Wrongful Federal Termination Claims  

Wrongful termination means that an employer has discharged, or fired or laid off an employee for illegal reasons in the eyes of law. There are various reasons of illegal termination including:

  • Termination as form of sexual harassment
  • Terminating an employee in violation of federal and state anti-discrimination laws
  • Violating oral or written employment agreements and firing employees
  • Firing an employee by violating labor laws including collective bargaining laws
  • Firing an employee in retaliation for the filing of a complaint or claim against the employer

Some violations attract statutory penalties while others can result in employer’s payment for damages for employee’s lost wages or other expenses. Certain cases may also raise the possibility that the employee will be entitled for monetary compensation.

If an employee has been laid off or fired recently, or he or she believes that they have lost their job for an unlawful or illegal reason, the employee has a right to bring a claim for wrongful termination against his or her former employer.

If an employee feels that he or she is wrongfully terminated because of any violations of legal terms or due to retaliation or discrimination, the employee can file a claim with the EEOC (Equal Employment Opportunity Commision). The employee can file a claim either through mail or by meting with the authorities in person. In most cases, before filing a lawsuit in the court, an employee must file a complaint with the EEOC. The complaint must be filed by mail or in person within 180 days. This can be extended to 300 days if the charge is also covered by anti-discrimination law.
