Though divorce and legal separation are both ways to come out of a marriage after its failure, they are different from each other in several aspects. Where divorce is considered for ending a marriage, a legal separation is not known to end the marriage. Legal separation is an order by the court that determines the responsibilities as well as the rights of the partners while they are allowed to live separately. But the legal separation is not likely to end their marriage as they remain in marriage. It is just that the spouses choose to live separately while remaining in marriage.

Legal separation is known to resolve every possible aspect in a marriage like the child support, child custody, financial issues, visitation as well as spousal support. As far as the differences between the two are concerned, the basic difference is that divorce ends a marriage while the other does not. Legal separation is a way of protecting the interests till the decision for filing a divorce is not made. In legal separation, there are chances that the couple may reconcile and may stay together after a certain time period.

Legal separation provides time to the spouses to reconsider the fact if they really want to get parted while divorce ends the relationship between them. The former also retains the medical benefits which are nowhere retained after a divorce. It also offers a better separation in terms of religious beliefs than a divorce. This also provides the Social Security benefits to the spouses.
