Restraining Order Requirements  

A restraining order is probably the solution you need if you are being harassed by a stalker, or are exposed to circumstances that lead to sexual assault or domestic violence. It involves seeking legal help from a court in preventing the person from continuing with his or her actions, and is mostly effective in keeping the situation under control.

So what exactly is a restraining order? It is legal document issued by a state court, that orders an individual who has caused you harm or has threatened to do so, to maintain a specific distance from you or run the risk of being fined and arrested. Even though the finer print may differ from state to state, the general purpose behind all restraining orders is to prohibit a person to come in close contact with you and harm you. It also gives the court powers to initiate action against the abuser if he or she violates the conditions stipulated in the restraining order.

This legal document has the right to order a person to stay away from you and avoid making contact of any kind. This includes keeping away from your workplace, home, or school, and not trying to connect through other means like over the telephone, email, or fax, sending notes or even flowers and gifts.

The Family Protection Act requires that in order to request a restraining order, a person has to be a minimum of 18 years old. If the person is younger, then the law requires that your abuser should be a minimum 18 years old, and also states that the victim has to be married or was married to the perpetrator, or the victim was in a sexual relationship with the perpetrator.
