The breach of fiduciary duty arises when a contract can be exposed and a pattern of mistreatment is established.

For example, in a medical malpractice case the lawyer for the plaintiff must be able to prove that there has been a malpractice and significant damages have been caused due to it. However, in logical circumstances if there has been a breach of fiduciary duty, then that itself is a cause for action.

It is important to understand what a fiduciary duty is and when it is called a breach. A fiduciary duty is the legal relationship of trust and confidence between two or more parties -- the fiduciary and the beneficiary. The role of the fiduciary here is to act on behalf of the other in a manner of trust and confidence. However, it is mandatory as per law that the fiduciary should not take advantage of his or her position and should not put his or her personal interests in front of their duty. It should always be duty first and they should always act on the interest of their beneficiary.

A breach of fiduciary duty would arise when the fiduciary has not acted on behalf of the beneficiary and has a selfish motive behind the act. If the fiduciary has acted in such a manner that they stand to benefit and their act has caused a loss or damage to the beneficiary, then it would be termed as the breach of fiduciary duty. The beneficiary has complete rights to pursue the fiduciary in the court of law and to file a law suit against him or her. This scenario is highly possible when there are trustees involved with a beneficiary as a stand alone.
