It can be quite irritating to have a neighbor's tree overhanging your property line. Is there anything you can do about it?

The first thing to do is check the laws about tree overhanging the property line. The laws clearly state that if the tree trunk is in one person's property and the branches overhang into another person's property, the other property owner has all rights to cut the branches if they are creating a nuisance.

This means that if a tree is overhanging into your property, you can cut the branches up to your property line without encroaching into your neighbor's property. However, before you take this step, it important that you first get an order from the district court to do the trimming or cutting of the overhanging tree. This will keep you safe from any legal action. The district court should only be approached if the tree is on the boundary and your neighbor is not agreeing to the cutting or trimming of the branches. When the tree is on the boundary, you and your neighbor are co-owners of the tree and both are liable for the damage it causes. On the other hand, if the tree is in your neighbor's property, then the neighbor is liable for any damages it causes. Make sure all the fruits and cuttings are put back into the neighbor's property without causing any damage to the neighbor's property. Or else, you can ask your neighbor to have them removed.

In addition, if your neighbor's tree is causing a nuisance like blocking light or sun, your neighbor will still be liable. According to the laws about tree overhanging property line, a person is also responsible if the tree in question is interfering in a person's enjoyment of his own property.
